Silver Teal Cooks - Terms and Conditions
Valid from 1st March 2008
In these Terms of Business the following definitions apply:
1.0 "Company" means Silver Teal Cooks, Fenton Barns, North Berwick, East Lothian, EH39 5AN
1.1 "Applicant" means the person introduced by the Company to the Client for an Engagement.
1.2 "Client" means the person, firm, organisation or corporate body to whom the Applicant is introduced.
1.3 "Engagement" means the engagement, employment or use of the Applicant by the Client on a permanent or short term basis whether under a contract of service or for services under an agency licence franchise or partnership agreement or any other engagement.
1.4 "Introduction" means the notification by telephone, fax or otherwise of the name and any further details of an Applicant by the Company to the Client upon request of the Client to search for an Applicant which leads to an Engagement of the Applicant by the Client.
2. Introduction leading to Engagement
Silver Teal is an introduction agency for cooks and other related staff. They maintain a database of such staff seeking employment on a permanent or part-time basis. When approached by a client seeking the services of such staff, Silver Teal will then refer an applicant from their database to the client, and it will then be for the client and the applicant to negotiate terms of engagement between them.
3. Fees
Where such referral leads to the engagement of the applicant by the client, the client will bacome liable for Silver Teal's fee which will be calculated in accordance with the Scale of Fees provided to the client. The client will be bound to advise Silver Teal of the renumeration agreed between the applicant and the client. Accounts are due for payment within 14 days on receipt of invoice.
4. Re-engagement
Where the client re-engages the applicant within a period of two years from the end of any engagement, the client will be responsible for payment of a further fee to Silver Teal in accordance with the then current Scale of Fees.
5. Suitability
Silver Teal carefully select all applicants after having interviewed them personally, but Silver Teal offer no warranty as to the suitability of any applicant for any particular engagement. The client will be deemed to have satisfied himself with regard to the applicant's suitability prior to engagement of the applicant.
6. Liability
Silver Teal accept no responsibility for any loss, damage or other liability incurred by the client as a result of their engagement of the applicant. The client will be responsible for arranging all necessary public, personal liability and employer's liability insurance.
7. Remuneration
The client will be responsible for paying the applicant and for recovering all necessary PAYE and Income Tax. Silver Teal will have no liability to the client or to the applicant for renumeration, holiday pay or sick pay.
8. Cancellation
When the client cancels the booking of an applicant within two weeks of the commencement of engagement, for employment up to one week, the client shall be responsible for the payment of half the applicant fee and full payment of Silver Teal's fee in accordance to their Scale of Fees. For the cancellation of an engagement of more than one week, the client shall be responsible for the payment of one week's agreed fee to the applicant, and full payment of Silver Teal's fee.
9. Law
These terms are governed by the Law of Scotland
